It depends. If you leave the scene, you sure can. You can be convicted of hit and run and vehicular manslaughter. If the person was on the sidewalk and you hit the person you probably will avoid jail if you stay to give assistance. Usually the police can tell the cirsumstances by skid marks, placement of the car, etc. Usually speed, any drinking, can determine if charges may be filed.
