I've been practicing law since 1993 and I cannot imagine any circumstances where you could file a motion to compel against your attornet. If your attorney has failed to act or do something on your case, then it is probably time to get a new a attorney. If your former attorney fails to do something like return your file to you, then perhaps it may be necessary to have your new attorney file a motion to compel return of the file.
